Chronology of this Dispute

October 18, 2010 – The Club Advisory Board, in a town hall presentation, announces a tentative global transaction (purchase) of substantially all Club assets for $73,500,000, the transaction to be completed by December 31, 2010. Approval is said to require a majority vote of the deferred equity members.

October 18, 2010 -- Gary Moselle tenders his resignation from the Desert Mountain Club by email.

November 2, 2010 – Gary Moselle confirms his resignation in a letter to Debbie Whelan at Desert Mountain Properties and asserts his right to forfeit any payment for reissuance.

November 10, 2010 – Heather Bruen, Staff Accountant at Desert Mountain Properties, confirms receipt of Gary's resignation and advises that his resigned membership has been placed on the Surrender membership List.

November 18, 2010 – The Club Advisory Board mails voting packages to members and requests that members “Vote Now.” The package advises that votes not accompanied by a check for at least $16,500 or a credit card authorization for $17,000 will not be counted.

December 13, 2010 – The Club Advisory Board announces that 51% of those eligible to vote have approved the global transaction. According to the announcement, three members voted against the global transaction and 923 declined to vote. The announcement cautions that members who refuse to pay their assessment will be subject to collection efforts, suspension and “all other remedies available to the club.”

December 19, 2010 – Gary Moselle launches the site DesertMountainGolfScam.com

January 1, 2011 – Bob Jones II, Chief Operating Officer / General Manager of the Desert Mountain Club, Inc. demands by email message that the site DesertMountainGolfScam.com be taken down and pledges to call Gary Moselle on Monday, January 3 to ensure that the site is down.

January 3, 2011 – Bob Jones and Gary Moselle discuss the site DesertMountainGolfScam.com and related issues for about ten minutes on the phone. Gary offers to remove the site DesertMountainGolfScam.com and issue a sincere apology if anything on the site either violates Arizona law or constitutes an intentional tort damaging the interests of the Desert Mountain Club. Gary suggests that this is a legal matter which could be settled by an exchange of memoranda of points and authorities between respective legal counsel. Bob pledges to take that offer to the executive committee of the Board.

September 16, 2016 – Jones Resignation
